Beach Road and Baines Crescent Special Charge Scheme

To help recoup some costs associated with the proposed construction of concrete footpaths in Beach Road and Baines Crescent, Torquay, Council intends to declare a Special Charge Scheme under Section 163 of the Local Government Act 1989.

Why do we need a special charge scheme?

The Local Government Act allows councils to introduce a special rate or charge scheme seeking property owner contributions towards infrastructure projects such as roads, footpaths and drainage improvements that will benefit them and that are not a part of the current capital works budget.

Council believes this footpath will provide a special benefit to the owners of properties abutting the road where the footpath will be constructed. A letter with full details of the proposed project has been sent to each affected property owner.

How much will it cost us?

In order to raise the amount of $24,000 (about 11% of the total cost of the project) a Special Charge is proposed for a period of four years.

The Special Charge is to be apportioned on the basis of access relative benefit and will apply to the properties identified as receiving a special benefit.

The remaining 89% (or $196,000) will be funded by Council and a Transport Accident Commission grant.

How can I make a submission about this proposal?

Any person affected by the proposed scheme can make a submission for consideration in accordance with section 223 of the Act. You may also request (in your submission) to be heard in support of their submission and/or to nominate a representative to present their submission.

Submissions must be received in no later than 5pm on Thursday 4 July 2019. The formal scheme declaration will be considered by Council on 23 July 2019 following consideration of any submissions.
