January 2018 Promotion Terms & Conditions (Game of Chance)

CONDITIONS OF ENTRY

PARTICIPATION

1. This promotion (“Promotion”) is conducted by Surf Coast Shire Council, 1 Merrijig Drive Torquay VIC 3228.

2. The Promotion is a game of chance.

3. Entry to the Promotion constitutes acceptance of these conditions.

4. The Competition is only open to Eligible Entrants. An "Eligible Entrant" is an individual who (i) is a resident of Victoria, Australia; (ii) is not an employee or councillor of the Promoter and (iv) is not a spouse, defacto spouse, parent, child or sibling (whether full, half, step or by adoption) of such an employee.

5. Promotion entry opens at 10.00am hours on 17/01/18 and ends at 11.59pm hours on 31/01/18. ("Entry Period"). All times and dates are times and dates in Melbourne, Australia which may be AEST or AEDT depending on the date.

FACEBOOK

6. The Promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook.

7. By entering the Promotion, each entrant releases Facebook, Inc from any and all liability to the entrant arising in any way from the conduct of the Promotion.

8. All information provided by an entrant is provided to the Promoter and not to Facebook.

ENTRY TO THE PROMOTION

9. To enter the Competition, an Eligible Entrant must post a photo of themselves playing The Fire Game board game on the corresponding Facebook post at www.facebook.com/surfcoastshirecouncil  by 11.59pm hours on 31/01/18.

10. By entering this Competition, each entrant:

(i) authorises the Promoter, its related bodies corporate and their agencies, without any restriction or royalty, to: (i) use the entrant's entry (including in an edited form) in material and on the internet to announce the winning entry; and (ii) contact the entrant regarding their entry;

(ii) warrants that he/she is entitled to authorise the Promoter to use the entry as permitted by these conditions;

(iii) warrants that the Promoter's use of the entry as permitted by these conditions will not infringe any rights (including without limitation any rights in copyright and any rights in respect of reputation) of any person; and

(iv) indemnifies the Promoter and all its related bodies corporate, contractors and personnel ("Indemnified Persons") from and against all losses, damage, claims (on any and all grounds), costs or expenses (including reasonable legal fees) that any of them may suffer as a result of any breach of conditions 10(i), 10(ii) or 10(iii).

11. All entrants must ensure that their entries are received by the Promoter during the Entry Period. The Promoter takes no responsibility for late or misdirected entries or for any delays or failures in any delivery service or equipment.

12. All entries to the Promotion may be subject to verification and confirmation by the Promoter. An entrant MUST deliver to the Promoter (by a means determined by the Promoter) copies of any documents the Promoter may request establishing eligibility to enter or win, including evidence of age, residence or identity. The Promoter may make one or more requests for such documents. Once the identity of documents available is established, an entrant must deliver requested copies within 7 days of being asked to do so. At the Promoter's request, an entrant MUST also, within 7 days of being asked, allow the Promoter to inspect and copy the original of any such document.

13. The Promoter may, at its absolute discretion, declare any or all entries made by an entrant invalid if the entrant: (i) fails to establish their entitlement to enter the Promotion to the Promoter's satisfaction; or (ii) fails to produce items as required by condition 12 or produces items that, in the Promoter's opinion, are illegible, stolen, forged, reconstructed, altered, incomplete or tampered with in any way; or (iii) in the Promoter's opinion, tampers with the entry process or benefits from such tampering; or (iv) in the Promoter's opinion, submits an entry which is not in accordance with these conditions.

PRIZE DRAW AND NOTIFICATION

14. The prize will be a random draw on Thursday 1 February 2018 at Council office at 1 Merrijig Drive Torquay.

15. The winner will be notified on the corresponding Facebook post. The Promoter can also publish the winning entry on its Facebook page for a period of its choosing, but is not obliged to do so.

PRIZES GENERALLY

16. If the prize (or part of the prize) is unavailable for any reason, the Promoter will, in its absolute discretion, substitute alternative goods or services of no lesser retail value and/or specification. The Promoter accepts no other liability or responsibility for any loss incurred by a winner or any other party if a prize (or part of a prize) is unavailable for any reason.

17. A right to receive a prize is not transferable or exchangeable and cannot be taken as a monetary payment.

GENERAL

18. If for any reason the conduct or operation of the Promotion is interfered with or disrupted in any way (including by vandalism, power failures, natural disasters, acts of God, civil unrest, strikes, computer bugs or viruses, tampering or technical failures), the Promoter reserves the right to cancel, terminate, modify or suspend or recommence the Promotion.

19. The Promoter assumes no responsibility for: (i) any error, omission, interruption, or delay in the operation or transmission of any communication sent to (or by) the Promoter or any entrant, (ii) any theft, destruction or unauthorised access to, or alteration of such communications; (iii) any problem with, or technical malfunction of, any computer system or other equipment used for the conduct of the Promotion; (iv) any incorrect or incomplete information which may be communicated in the course of the administering this Promotion (whether as a result of one of the foregoing causes or otherwise).

20. Caution: any attempt to cause damage to any website or the information on any website associated with this promotion or to otherwise undermine the fair and legitimate operation of this competition may be a violation of criminal and civil laws. The promoter reserves the right to seek damages to the fullest extent permitted by law in the event that any such attempt is made, whether or not that attempt results in any such damage, interference or undermining.

21. All of the Promoter’s decisions are final and no correspondence will be entered into.

22. To the full extent permitted by law, the Promoter, its associated companies and agencies and any of their personnel (the "Relevant Parties") exclude all liability for any loss (including any damage, claim, injury, cost or expense) which is suffered or incurred by any Eligible Entrant in connection with the Promotion or Prize, including: (i) any indirect, economic or consequential loss; (ii) any loss arising from the negligence of a Relevant Party; (iii) any liability for personal injury or death. Nothing in these conditions is intended to exclude, restrict or modify an entrant’s rights under the Competition and Consumer Act 2010.

23. The winner consents to the Promoter using their name, likeness, image and/or voice (including any photograph, film and/or recording of them) in any media at any time or times without remuneration for the purpose of promoting this Promotion.

Entrants' personal information will be collected by or on behalf of the Promoter to enable it to administer the Promotion and publicise its winners. Persons may contact the Promoter at the address in condition 1 to request access to, or corrections of, any of their collected personal information that is held by the Promoter. If an entrant does not provide accurate personal information the Promoter may determine that they are not eligible to win a prize.
