Cypress Lane - intent to discontinue the road reserve and sell land

Council decided at its 28 February 2023 meeting of its intention to discontinue the road reserve and sell the land known as Cypress Lane, Torquay. Council also decided that it intends to sell another parcel of public land in the vicinity, titled Reserve Number Three.

Council was approached by the abutting land owner of Cypress Lane - Coombes Road Pty Ltd - with a request to purchase Cypress Lane and a portion of Reserve Number Three. The potential sale is conditional on the land being used to provide accommodation for older community members and people with a disability. The sale of the land can only proceed if a planning permit is approved by Council.

Council invited submissions on the proposed discontinuance of the road and the intent to sell Cypress Lane and the proposed removal of reservation and sale of part of the land known as reserve number three. Submissions closed 7 April 2023.

Proposed Discontinuance and Sale – Cypress Lane Torquay

Surf Coast Shire Council, acting in accordance with Clause 3 of Schedule 10 of the Local Government Act 1989 proposes to discontinue the road reserve and sell the land, known as Cypress Lane Torquay (Lot R1 on plan number PS305011) as shown on map below to an adjoining property owner.

Submission Process (closed 7 April 2023)

In accordance with Section 223 of the Local Government Act 1989, Council’s Community Engagement Policy and Sale, Exchange or Transfer of Council Land Policy, submissions are invited on the proposed discontinuance and sale of Cypress Lane, Torquay.

All submissions received will be considered.

A person making a submission is entitled to appear in person at the Hearing of Submissions Meeting at a date and time to be determined by Council.

Proposed Removal of Reservation and Sale of part of Reserve No 3 Torquay

Surf Coast Shire Council, gives notice of intention to remove the reserve status on 1697 m2 of Reserve Number 3, Torquay RES3 on PS305011 identified in hatched plan below under Section 24A of the Subdivision Act 1988 and sell the land in accordance to Section 114 of the Local Government Act 2020  to adjoining property owner.
